The Report on Third-Party Assessment of the Work of Basically Overcoming Difficulties in the Execution of Court Judgments in China (2016), completed by the Innovation Project Team on Indices of Rule of Law and the Research Center on National Indices of the Rule of Law of CASS Law Institute, was recently published by China Social Sciences Press as part of the book series National Think Tank. The book assesses the work carried out by Chinese courts in basically overcoming the difficulties in the execution of court judgments in China in 2016. The following is a summary of the assessment report:
In March 2016, the President of the Supreme People’s Court solemnly announced at the Fourth Session of Twelfth NPC that “China will overcome the difficulties in the execution of court judgments within two or three years”. In 2016, under the leadership of the CPC and with the support of the whole society, the Supreme People’s Court had basically completed the top-level design of the relevant institutions and the informatization system; local people’s courts had made effective innovations and explorations in the execution of court judgments; pilot courts had been continuously deepening the reform of the execution system in an orderly way; and satisfactory results had been achieved in the implementation of various special projects. In 2017, the Supreme People’s Court needs to further strengthen the top-level design, activate the existing systems, construct a unified and complete set of standard, raise the level of the construction and utilization of the informatization system, and establish a normalized punishment reward mechanism with respect to the execution of court judgments. Local people’s courts at various levels should, under the leadership of Party committees at various levels, conscientiously implement the execution norm system, strengthen the construction of informatization system, and raise the level of coerciveness and standardization of the execution work. It can be expected that, under the “new normal” of economic downturn, the number of cases of execution brought about by the new case-filing registration system will drastically increase, further intensifying the problem of heavy caseload. Therefore, China will still be faced with big challenges in overcoming the difficulties in the execution of court judgments.
