The Third Innovation Forum of CASS Law Institute and CASS Institute of International Law in 2018was successfullyheld at CASS Law Institute in Beijing on June 5, 2018. The lecture, “the Exploration of Judicial Laws”, was given by Professor Xu Hui, a research fellow at CASS Law Institute. It was presided over by Professor Liu Renwen, chief researcher of the innovation project “Construction of Criminal Rule of Law and the Development of Criminal Law Science”, and attended by over 40 scholars and graduate students from the Institute of Law and Institute of International Law. Professor Huang Fang, Associate Professor Ma Ke, and Associate Professor Jiao Xupeng served as commentators at the lecture.

 

In the lecture, Professor Xu first introduced the background and significance of the topic of this forum, then analyzed from the perspective of objective necessity of judicial laws the scientific, civilized and standardized development of administration of justice, as well asits basic process and future trend of development, and analyzed from the perspective of intrinsic relationship the content and intrinsic requirements of such judicial laws as the law of judicial structure, the law of judicial procedure, and the law of judicial value.

Finally, she analyzed some of the important measures taken by China in the current round of judicial reform from the multiple perspectives of the universality and particularity of judicial laws, native practice and international experiences, plurarity and hierarchy difference, and long-term and short-term differences, and put forward her own opinions on how to realize the objective of “letting the people feel fairness and justice in every judicial case” under the precondition of compliance with judicial laws.
