The Fifth Lecture of Innovation Forum of CASS Law Institute and CASS Institute of International Law in 2017 Successfully Held

On September 12, 2017, the fifth lecture of the Innovation Forum of CASS Law Institute and CASS Institute of International Law in 2017 was successfully held in the conference room of the two institutes. the lecture, entitled “What Are the Innovations of the General Provisions of the Civil Law of the PRC”, was given by Professor Zou Hailin, an executive researcher of the innovation project “Deepening the Economic Reform and Improving the Civil and Commercial Law System in China”, presided over by Professor Chen Jie, the chief researcher of the project, and attended by about 60 experts, scholars and students from the two institutes. In the lecture, Professor Zou first pointed out that the General Provisions of the Civil Law adopted on March 15, 2017 is of great significance as the first step towards the codification of the Civil Law in China. However, one phenomenon in the formulation of the law is noteworthy: there had been a large number of controversies in the draft of the General Provisions involving almost every provision of the law and the controversies continued even after the adoption of the law. Next, Professor Zou explained how the 1986 General Principles of the Civil Law of the PRC had influenced the Chinese people’s civil law ideas during its thirty years implementation and the current civil law codification in China from the perspectives of the interpretation and application of such terms as “civil law subject”, “autonomy of will”, and “civil liability” and the structural design of the General Provisions of the Civil Law. Finally, Professor Zou analyzed the concrete institutional innovations and logic expressions of the General Provisions of the Civil Law within the framework of “civil subjects”, “civil rights” and “civil liabilities” that highlights the native context.
