The Academic Seminar on the Standardization of Commercial Guiding Cases Successfully Held in Beijing

On April 22, 2017, the Academic Seminar on the Standardization of Commercial Guiding Cases was successfully held in Beijing. The seminar was organized by CASS Law Institute and attended by over 40 experts and scholars from over a dozen universities and research institutions throughout the country. At the seminar, which was divided into four units, the participants gave keynote speeches and carried out discussions on various issues around the theme of the seminar, including the necessity of promulgating guiding cases, the legal source status, the mechanism for the formation, and the error-correcting functions of commercial guiding cases; the remedy for the incorrect application of law in arbitration cases; the position of commercial guiding cases as customary commercial law; the refinement of the rules of commercial arbitration; the special nature of commercial guiding cases and the difference between guiding cases and judicial interpretation; commercial guiding cases from the points of view of parties, lawyers, judges, and scholars; and the functional values of commercial guiding cases from the perspective of legal dogmatics.
