Professor Mo Jihong: Ensuring the Safety of Key Information Infrastructure Vital to National Security

On April 14, 2014, Professor Mo Jihong, Deputy Director of CASS Law Institute, was interviewed by the newspaper Legal Daily on the importance of key information infrastructure to national security. In the interview, Professor Mo pointed out that the National Security Law has incorporated the network and information safety into the scope of national security and stressed the important strategic task of construction of the key information infrastructure and s ensuring the safety and controllability of information system and data in key areas. The normal operation of key information infrastructure in the information era depends heavily on the information technology and information network. Therefore, overcoming the security risks resulting from the vulnerability of information technology and information network themselves and various human factors has become an important content of protection of national security. In order to strengthen the safety of key information infrastructure, it is necessary to take the law as the key link and realized the coordinated development of technological, management, and personnel systems. Article 78 of the National Security Law provides that authorities, people's groups, enterprises, public institutions, and other social organizations shall provide education on maintaining national security to their personnel, and mobilize and organize their personnel to prevent and frustrate conduct that compromises national security. As for people who leak information about key information infrastructure, they should be given corresponding administrative punishments in accordance with the Public Security Administration Punishments Law. Those whose acts are serious enough to constitute a crime shall be given criminal punishment in accordance with provisions on the crime of endangering national security in the Criminal Law. Moreover, it is necessary to carry out education of citizens on national security.
