Professor Liu Renwen Attends an Expert Consultation Meeting on the Exposure Draft of the Regulations on the Handling of Illegal Fundraising

On September 12, 2017, the Expert Consultation Meeting on the Exposure Draft of the Regulations on the Handling Illegal Fundraising Cases, jointly organized by the Research Department of China Law Society, the Criminal Research Committee of China Law Society and Banking Law Research Committee of China Law Society, was held in Beijing. The meeting was presided over by Mr. Zhu Xiaoqing, a former Deputy Procurator-General of the Supreme People’s Procuratorate and attended by a dozen prominent scholars and experts in the field of criminal law in China, including Professor Liu Renwen, the head of the Criminal Law Department of CASS Law Institute. At the beginning of the meeting, Mr. Zhou Cheng from the Financial Department of the Legislative Affairs Office of the State Council and Mr. Wenzhen from China Banking Regulatory Commission gave an introduction to the background and main considerations of Exposure Draft of the Regulations on the Handling Cases of Illegal Fundraising. The participants unanimously agreed that it is very necessary to adopt legislation on the handling of illegal fundraising cases because currently the high occurrence of illegal fundraising cases has disrupted normal economic and financial orders, damaged people’s interests, and affected social stability; the Exposure Draft of the Regulations on the Handling Cases of Illegal Fundraising fills in a legislative gap in and covers all major issue relating to the handling of illegal fundraising, gives a definition to illegal fundraising, provides for the division of functions among various bodies relating the handling of illegal fundraising, clarified the relevant preventive and monitoring responsibilities, and therefore is of great legislative value. The scientific definition of illegal fundraising, the designation of forceful regulatory bodies, the clarification of the legal responsibilities of the regulators, the protection of the rights and interests of illegal fundraisers and participants are the core issues of the legislation. At the end of the meeting, the experts and scholars put forward suggestions on the further revision and improvement of the Draft Regulations with respect to the title of the regulations, the definition of illegal fundraising, and the regulatory bodies and their responsibilities.
