Professor Liu Haibo attends Expert Consultation Meeting on the Draft Amendment to the Law on Specialized Farmers Cooperatives (Draft Revision)

On July 14, 2017, the Expert Consultation Meeting on the Draft Amendment to the Law on Specialized Farmers Cooperatives and the Sixteenth China Law Society Legislative Expert Consultation Meeting in 2017 were held in Beijing. The meeting was organized by the Research Department of China Law Society, chaired by Professor Zhang Wenxian, Vice Chairman of China Law Society, and attended by 13 prominent experts in the field of farmers’ cooperatives in China, including Professor Liu Haibo, a research fellow at CASS Law Institute. At the meeting, Mr. Shi Chunfeng, Deputy Head of the Economic Law Office of the Legislative Affairs Commission of the Standing Committee of the National People’s Congress, introduced the participants to the background and main considerations of the Draft Amendment to the Law on Specialized Farmers Cooperatives. The experts and scholars unanimously agreed that the revision of the Law embodies the high importance attached by the CPC Central Committee on the unique role played by formers’ cooperatives in the economic development in rural areas, is adapted to the new situations and new demands of specialized farmers’ cooperatives, and will further promote the standardized, smooth and healthy development farmers’ cooperatives in the country. They held that some parts of the Draft Amendment, especially the parts on the ownership of the properties of farmers’ cooperatives , the property liability system and the system of remedy of the rights of members of cooperatives need further consideration and demonstration and they put forward suggestions and proposals on the improvement of the title of the law, the definition of farmers, the subject status and organizational form of farmers’ cooperatives, the establishment of branches of farmers’ cooperatives, the funding of the land management right, the relationship between the government and farmers’ cooperatives, the proportion of farmers in the cooperatives, the procedure for the admission of new members, substantive elements of expulsion of members, the final disposal of property and the related responsibilities, the prevention of monopoly, and the linkage the Law on Specialized Farmers Cooperatives and General Principles of Civil Law and other laws.
