The Sixth Innovation Forum of CASS Law Institute and CASS Institute of International Law in 2016 was successfully held at the conference room of the two institutes on the morning of September 13, 2016. At the Forum, Mr. Jin Shanming, an executive researcher of the innovation project “Deepening of Economic Reform and Improvement of the Commercial Legal System in China”, gave a lecture entitled “Limitations of the Regulation of Abuse of Dominant Market Position”. The lecture was presided over by Professor Chen Jie, the Chief Research of the Project. Professor Zou Hailin served as the commentator of the lecture. In the lecture, Mr. Jin discussed issues relating to the limitations of the regulation of abuse of dominant market position mainly from the perspectives of the logic of regulation of abuse of dominant market position, the definition of relevant markets, the determination of dominant market position, and the determination abusive behavior. Through the analysis of the relevant cases, he explained the textual meanings of relevant legal provisions and challenges faced by courts in judicial practices, as well as existing problems in the enforcement of anti-monopoly law in China during the period of social transition. In his commentary, Professor Zou analyzed the role of anti-monopoly law in a market with insufficient competition and stressed that anti-monopoly law, as a policy tool used by the government to intervene in the market economy, has a great impact on new economic forms and modes and on the existing regulatory policy and, therefore, should be apply with caution.
