Professor Tian He Attends “Expert Seminar on the Openness of Adjudicative Documents” at the Supreme People’s Court

On the morning of August 31, 2016, the “Expert Seminar on the Openness of Adjudicative Documents” was held at the Supreme People’s Court. The seminar, aimed at raising judicial capability and more efficiently utilizing big data, was presided over by Mr. Jiang Huiling, Director of China Institute of Applied Law Science of the Supreme People’s Court, and attended by over 60 persons, including scholars and experts from prestigious universities and research institutions, representatives from the local people’s courts of Shenzhen City, Zhejiang Province, Beijing, and Shanghai, and officials from various departments of the Supreme People’s Courts. At the seminar, the participants carried out discussions on various issues relating to the work done by Chinese courts in the openness adjudicative documents and the revised Provisions of the Supreme People's Court on the Issuance of Judgments on the Internet by the People's Courts, including the improvement of judicial capability through the openness of adjudicative documents, the linkage between adjudicative documents and judicial big data, judicial openness and protection of privacy, and the deepening and improvement of the openness of adjudicative documents. Professor Tian He, Head of the Department of Survey and Studies of National Situation of Rule of Law, CASS Law Institute, attended the seminar. In her speech, Professor Tian pointed out that the Supreme People’s Court has done a large amount of work in promoting the online disclosure of adjudicative documents. Many proposals put forward by scholars, such as those relating to the disclosure of case numbers and presiding judges in the case, have been embodied in the revised Provisions. As for the “save clause” retained in the Provisions, she suggested that more detailed rules of implementation should be adopted to prevent the abuse of such provisions.
