The Seminar on the Legislative Coordination between the Guardianship System and the Title on Marriage and Family in the Chinese Civil Code Held at CASS Law Institute

On the afternoon of April 7, 2016, the Seminar on the Legislative Coordination between the Guardianship System and the Title on Marriage and Family in the Chinese Civil Code, jointly organized by the Marriage and Family Research Committee of China Law Society and CASS Law Institute, was held at the conference room of CASS Law Institute. The seminar was presided over by Professor Xia Yinlan, Chairwoman of the Marriage and Family Research Committee and attended by a number of scholars and experts from various government organs, universities and research institutions, such as the Law School of Renmin University of China, the Legislative Affairs Commission of the Standing Committee of the National People’s Congress, the Law School of Peking University, China Women’s University, and CASS Law Institute. At the seminar, the participants carried out in-depth discussions and reached consensus on various issues relating to the legislative coordination between the guardianship system and the title on marriage and family in the Chinese Civil Code, including the principle of the best interest of the minors under guardianship; respecting the will of adult persons under guardianship; the rights, obligations and duties of guardians; the system of supervision over guardianship; the division of work and the coordination, between the guardianship system and the tile on marriage and family in the Chinese Civil Code; the concept and principle of guardianship, legal relationship between the guardian and the person under guardianship; the classification of guardianship; the change, termination and cancellation of guardianship; etc.
